Obligation to Help Persecuted Muslims (in Gaza) According to Islamic Law

Throughout history, it is seen that people have been oppressed and persecuted because of their beliefs and differences. In today’s world, where it is claimed that advanced levels of democracy and human rights have been reached, people are killed because of their beliefs and differences, and they are subjected to oppression and persecution. One of the persecuted communities is the Palestinian Muslims living in Gaza. Since 1948, Israel has occupied Palestinian lands and oppressed, persecuted and tortured its people. Israel’s murder, cruelty and torture evolved into a new dimension on October 07, 2023 and turned into genocide, a crime against humanity. Since 07.10.2023, Israel has killed 41,909 people, mostly children and women, and injured 97,303 people. Muslims have strategic, economic and military obligations to put an end to this ongoing killing, torture and persecution of the Palestinian people.

As a requirement of Muslims’ obligation to “help each other with the consciousness of goodness and servitude to Allah,” Islamic countries must cooperate; they must avoid entering into an alliance against Muslims. In this context, Islamic countries must sever diplomatic and strategic relations with Israel; they must not cooperate with third countries in actions that may be against the Palestinians, and they must not share confidential information with Muslims that may be against them.

In Islamic law, it is not permissible to sell weapons, ammunition, spare parts and raw materials used in the production of weapons to countries and groups that harbor hostile feelings towards Islam and Muslims and/or attack an Islamic country. In addition, in order to dissuade non-Muslims who unjustly wage war against Islamic countries and oppress and persecute Muslims, to discourage these actions and force them to make peace, restrictions may be imposed on the sale of basic necessities such as foodstuffs, clothing and oil other than weapons. In this context, in order to put an end to the murder, torture and oppression of the Palestinian people, strategic goods such as raw materials and oil used in the production of weapons should not be sold to Israel and the countries that support it. In addition, the ban on imports from the aforementioned countries; Individually, it is also among the obligations not to buy the goods of this country. In addition, to extend a helping hand to Palestinians who are deprived of basic needs such as food, drink and shelter under Israeli oppression; to treat the sick and wounded, to provide medicines and medical supplies; It is one of the duties of Muslims to offer a safe home to Palestinians who have taken refuge in other Islamic countries by opening their borders.

According to the majority of Islamic scholars, since attacking Muslims, denying them freedom of life, property and belief and applying oppression and cruelty to them is a justification for war, military intervention will become legitimate if diplomatic and economic measures are not effective and Israel continues to commit this crime against humanity.In this respect, it would be appropriate for the United Nations Peacekeeping Force to take the necessary steps to carry out this intervention, and if this is not possible, it would be appropriate to plan such an intervention by the member states of the Organization of Islamic Cooperation.
